A. General Terms and Conditions

1.        Before you use a KUOTA product, please read all the terms and conditions. We include these terms and conditions to protect all our customers. They also serve as the principles to which our service will adhere. Please read each term and condition carefully. Once you register or begin using KUOTA products, you are deemed to understand and agree with all the terms and conditions.

2.        KUOTA always respects and aims to protect our users' rights in using this product (including user privacy, personal information, etc.). KUOTA owns all the intellectual property rights of its products (including copyrights, patent rights, trademark rights, etc.). Access to KUOTA's website does not mean that you are entitled to any copyright or intellectual property right related to the content of our website. In accordance with regulations from all countries and international laws, all the copyrights are protected accordingly.


B. Order and Payment

1.        KUOTA has distributors in most countries around the world. We recommend that you purchase KUOTA products locally. Please visit Kuota distributors page to find a KUOTA retailer near you: http://www.kuota-cycle.com/Kuota-in-the-world/

2.        When you place your order via our website, you are paying via the third-party payment service, PayPal, and may choose to pay with Credit card/Apple Pay/Google Pay etc. ,All KUOTA transactions are made in US Dollars. If you are using a credit card from another country, your credit card company may charge extra fees for international transactions or currency differences. KUOTA does not receive any revenue from these additional fees. Please contact your credit card company to learn more. Once the payment is completed, your product is successfully ordered. KUOTA will reserve your in-stock product, but the order is not completed until the product is delivered from our warehouse to you. We reserve the right to reject any payment or to cancel any order at our discretion

3.        All prices are exclusive of sales tax, GST or other taxes which if payable is to the Buyer's account. All information provided on website for sales tax, GST, duties and other shipping and/or handling charges are for information and no guarantees are made for their accuracy at time of purchase


C. Product Delivery

1.        After the order is placed, we will do our best to deliver your product within the expected time. If the time needed to process the delivery exceeds what is expected, we will notify you and process your order as soon as possible. When your product is delivered, we will also send you a delivery notice/shipping list via email. 

2.        Failure to make any delivery and/or defective delivery does not prejudice the right of the Seller to make subsequent deliveries, nor does it entitle the Buyer to refuse to accept the same or to terminate the Contract either as a whole or in part or to any right or claim for damages whether for delay, non-delivery or otherwise


D. Return and Cancellation

1.        If the Buyer cancels any order or refuses to accept all or any of the Goods in an order other than in circumstances permitted in these Terms of Sale, the Buyer will be liable for any resulting damage or loss suffered by the Seller.

2.        You have 14 calendar days to return an item from the date you received it. A 5% restocking fee will be assessed on returns. To be eligible for a return, your item must be unused and in the same condition that you received it. Your item must be in the original packaging. Your item needs to have the receipt or proof of purchase. You will be responsible for ensuring the bike or frameset is returned to us in its original condition

3.        If you need to make a return, please first contact us to arrange where to send the package. Please note that you will be responsible for your own shipping and related costs when returning your purchase. 4.        Should you find any items or parts missing from your order, please contact our Customer Service team immediately within 14 days of receiving your delivery. Upon receipt of your claim, we will thoroughly investigate the issue and, if validated, will arrange for the missing part(s) to be shipped to you at no extra cost. We strongly encourage customers to inspect their delivery thoroughly upon receipt to ensure all items are present. Please note that any claims for missing items or parts made after this 14-day period may incur additional charges. In such cases, the customer will be responsible for the costs of shipping for any missing items or parts.

5.        If you purchased from a physical store, please report the defect directly to your seller. KUOTA online customer services only handles returns and exchanges from online sales.


E. Refunds

Once we receive your item, we will inspect it and notify you that we have received your returned item. We will immediately notify you on the status of your refund after inspection. If your return is approved for return, we will initiate a refund via your original method of payment. Please note that the time it takes for you to receive a refund is subject to your payment processor’s refund policies.


F. Errors, Inaccuracies and Omissions

1.        We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any color will be accurate.

2.        Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.


G. Privacy Protection

        1.      All the data obtained from your membership registration and other personal information (such as transaction data) will be protected and regulated by the privacy policies of our website.

        2.      We will not disclose to others any personal information you provide us without your authorization, such information includes your name, address, email, and other data protected by laws.

        3.      Protection of Personal Information

  KUOTA holds responsibilities to its members and clients, and shall abide by the laws. We will handle personal data collected from clients in the following ways:

1)       We shall only process the personal information when necessary.

2)       We shall only collect and process minimal personal information only when it is required.

3)       We shall respect the personal information rights of our clients, including their rights to retrieve, save, and edit this data.

4)       We shall make sure that all users’ personal information is kept safe.

5)       We shall be entitled to the exemption allowed in laws related to personal information protection.

6)       We shall develop and construct a personal data management system to fulfill this policy.
